1. Scope
These Terms and Conditions (“Terms”) apply to all yacht tours and yacht rental services (“Services”) provided by GOOD VIBE Yacht Renting (“Company”) to its customers (“Client”). Use of the Company’s website (www.yachthurghada.com) and booking a Service constitutes acceptance of these Terms.
2. Booking and Payment
- Booking: Bookings must be made through the Company’s website or by contacting a Company representative. A deposit may be required at the time of booking, with the remaining balance due before the Service date.
- Payment Methods: The Company accepts credit cards, bank transfers and cash.
- Refunds and Cancellations:
- Client Cancellations: Client cancellations will be subject to fees depending on the time of cancellation relative to the Service date. Details to be specified [e.g., Cancellation with more than 30 days’ notice: 50% refund; Cancellation with less than 7 days’ notice: No refund.]
- Company Cancellations: If the Company must cancel a Service, a full refund will be issued or, if possible, rescheduling will be offered. The Company is not liable for additional costs incurred by the Client due to cancellations.
3. Yacht Conditions
- The yacht is provided in good working condition and meet all applicable Egyptian safety regulations.
- The Client is responsible for any damage or loss caused to the yacht or equipment exceeding normal wear and tear during the rental period.
4. Security Deposit
A security deposit is required for all yacht rentals. The deposit amount will be determined based on the size and value of the yacht. The deposit will be fully refunded upon the return of the yacht in an undamaged condition, barring any deductions for damage or breach of these Terms.
5. Insurance
- The Company maintains appropriate insurance coverage for its yacht, including [specify types of insurance, e.g., hull, liability, etc.].
- Clients are strongly advised to obtain personal travel insurance covering accidents, medical emergencies, trip cancellations, and any other potential risks.
6. Client Responsibilities
- Yacht Use: The Client is responsible for operating the yacht (if applicable) in a safe and responsible manner, in accordance with all applicable laws and regulations, and within the designated navigational area.
- Required Documentation: The Client must possess all necessary licenses and permits for operating a yacht if they choose to do so.
- Prohibited Activities: The Company reserves the right to terminate the Service immediately if prohibited activities are observed.
7. Force Majeure
Neither the Company nor the Client shall be liable for delays or non-performance due to unforeseeable events beyond their control, such as weather conditions, natural disasters, or government restrictions (“Force Majeure”).
8. Limitation of Liability
The Company shall not be liable for any indirect, incidental, or consequential damages arising from the use of its Services, even if advised of the possibility of such damages. The Company’s maximum liability shall not exceed the total amount paid by the Client for the specific Service.
9. Governing Law and Disputes
These Terms, and any disputes arising from them, shall be governed by and interpreted in accordance with the laws of Egypt. Any disputes that cannot be amicably resolved shall be settled in the competent court of jurisdiction in Egypt.
10. Changes to Terms
The Company has the right to modify these Terms at any time. Updated Terms will be posted on the Company’s website.
